Suppose the federal courts did not assert the power of judicial review established in the case of Marbury v. Madison (1803). Without judicial review, all laws passed by Congress and signed into law by the president would be considered constitutional.
How would this change the American political system? At a minimum, it would add to a note of efficiency to the Madisonian system. Would you favor such a change? Would Madison? Why or why not?
